The article discusses issues of interaction between the scientific systems of Eastern and Western Europe in the context of current global and local conflicts. Also, ethical issues are considered in connection with solving such problems in science, as well as examining similarities and differences of the scientific systems and their possible modelling. Some practical recommendations are included, based on the suggested academic speculations.

Die demografische Entwicklung und der medizinische Fortschritt werden die Problematik der Ressourcenknappheit im deutschen Gesundheitswesen in Zukunft weiter verschärfen. Soll nicht nur kurzfristig akuten Sparzwängen ausgewichen werden, steht – wie in verschiedenen Ländern bereits geschehen – auch Deutschland auf Dauer eine Prioritätensetzung im Gesundheitswesen bevor. Diese sollte in möglichst transparenter Weise nach klaren Kriterien erfolgen. Eines der seit einiger Zeit häufig öffentlich zitierten Kriterien der Verteilung von Mitteln in der Gesundheitsversorgung ist die Eigenverantwortung von Patienten. Deren Berücksichtigung in der Allokation (...) von Ressourcen birgt allerdings zahlreiche Probleme. Der vorliegende Beitrag untersucht die gerechtigkeitstheoretischen Grundlagen und die praktischen Probleme bzw. die möglichen Konsequenzen von Eigenverantwortung als Verteilungskriterium im Gesundheitswesen. Auf der Grundlage eines alternativen gerechtigkeitstheoretischen Vorschlags werden drei Möglichkeiten skizziert, Eigenverantwortung von Patienten im deutschen Gesundheitswesen in gerechter Weise stärker zu betonen. ABSTRACT Many people now believe that human reproductive cloning – once sufficiently safe and effective – should be permitted on the grounds that it will allow the otherwise infertile to have children that are biologically closely related to them. However, though it is widely believed that the possession of a close genetic link to our children is morally significant and valuable, we argue that such a view is erroneous. Moreover, the claim that the genetic link is valuable is pernicious; it (...) tends to give rise to highly undesirable consequences, and therefore should be combated rather than pandered to. The emphasis on the genetic is unwarranted and unfortunate; rather than giving us moral reason to support reproductive cloning in the case of infertility, the fact that cloning requests are likely to be motivated by the genetic argument gives us reason to oppose its availability. Historically, scientists in training have learned the rules of ethical conduct by the example of their advisors and other senior scientists and by practice. This paper is intended to serve as a guide for the beginning scientist to some fundamental principles of scientific research ethics. The paper focuses less on issues of outright dishonesty or fraud, and more on the positive aspects of ethical scientific behavior; in other words, what a scientist should do to maintain a high level of ethical (...) conduct in research.There are a number of fairly specific rules, guidelines, or commonly accepted operating principles that have evolved for the ethical conduct of science. In order to discuss this code of ethics, this paper is divided into sections dealing with specific areas of scientific ethics. These areas are: data collection and storage, ownership of data, confidentiality, communication, authorship, collaboration, the peer review system, and rules of dealing with ethical complaints. Illustrative case histories are presented to provide examples of the type of ethical dispute or problem being discussed. If scientific trainees learn the accepted rules of behavior that govern the conduct of science, ethical problems that arise out of ignorance, misunderstanding, or poor communication can be avoided. Paul Johnston demonstrates that much recent moral philosophy is confused about the fundamental issue of whether there are correct moral judgements. He shows that the standard modern approaches to ethics cannot justify - or even make much sense of - traditional moral beliefs. Applied rigorously, these approaches suggest that we should reject ethics as a set of outdated and misguided claims. Rather than facing (...) up to this conclusion, most recent moral philosophy consists of attempts to find some ways of preserving moral beliefs. This places a contradiction at the heart of moral philosophy. As a resilt it is often impossible to tell whether a contemporary philosopher ultimately rejects or endorses the idea of objective right and wrong. On the basis of a Wittgenstein approach Paul Johnston puts forward an alternative account of ethics that avoids this contradiction and recognises that the central issues of ethics cannot be resolved by conceptual analysis. He then uses this account to highlight the contradictions of important contemporary moral theorists such as Bernard Williams, Alasdair MacIntyre, Thomas Nagel and Charles Taylor. (shrink)

In diesem Artikel geht es um die Beziehungen zwischen der von Jürgen Habermas entwickelten Diskursethik und den Studierendenseminaren, die der Ulmer Arbeitskreis „Ethik in der Medizin“ veranstaltet. Zunächst erfolgt eine Darstellung der Kernaussagen der philosophischen Diskursethik. Sie liefert eine formale Argumentationsprozedur, mit der es möglich ist, die Legitimität strittig gewordener Normen im Diskurs zu prüfen. Anschließend wird das in Ulm von Baitsch und Sponholz entwickelte Modell der Seminare „Ethische Entscheidungskonflikte im ärztlichen Alltag“ vorgestellt. Da sich die Ulmer Seminare unter anderem (...) auf die Diskursethik als theoretischen Hintergrund berufen, werden die Gemeinsamkeiten und Unterschiede beider Konzepte untersucht. Der Hauptunterschied ist der zwischen einem Begründungs- und einem Anwendungsdiskurs. Gemeinsam sind den Ansätzen die grundsätzlich kognitivistische Einstellung und die „Spielregeln“ des Diskurses. Eines der medizinischen Felder, in dem die ethische Diskussion um die „wunscherfüllende Medizin“ am intensivsten geführt wird, ist die Reproduktionsmedizin, die die Erfüllung des „Kinderwunsches“ verspricht. Strittig ist besonders, ob Sterilität als Krankheit definiert wird, die eine medizinische Intervention rechtfertigt, ob sich aus der Sterilität oder Infertilität lediglich ein Abwehr- oder auch ein positives Anspruchsrecht auf medizinische Ressourcen ergibt, ob legitime Fortpflanzungsmedizin Grenzen hat. Nach einer Übersicht über Eckpunkte der nationalen und internationalen Debatte beschreiben wir im zweiten Teil Ansichten zum (...) Status ungewollter Kinderlosigkeit, zum Recht auf Fortpflanzungsmedizin und zur möglichen Legitimität ihrer Begrenzung anhand der Ergebnisse unserer vom Bundesministerium für Bildung und Forschung (BMBF) geförderten Studien. Während der letzten fünf Jahre haben wir u. a. Paare mit und ohne Sterilitätsproblematik sowie verschiedene Expertengruppen qualitativ und standardisiert befragt. Die stark divergierenden Auffassungen konfrontieren wir im dritten Abschnitt mit internationalen Standards, zum anderen mit dem „Capability-Ansatz“ und dem freiheitsfunktionalen Liberalismus von Sen und Pauer-Studer. Dies ergibt, dass die Bereitstellung verschiedener Möglichkeiten der In-vitro-Fertilisations-(IVF-)Behandlung nicht lediglich einen Wunsch auf Elternschaft erfüllt sondern als die gesollte Erfüllung eines normativen Bedürfnissanspruchs begriffen werden muss. This person would assume several roles: as asounding board to those needing confidential consultation about research issues — basic, applied or clinical; as afacilitator for those wishing to pursue a formal grievance process; and as aneducator to distribute guidelines and standards, to raise the consciousness regarding sloppy or irregular practices in order to prevent misconduct and to promote the responsible conduct of research. Die jüngste höchstrichterliche Rechtsprechung zur Selbstbestimmung der Patienten und zur Normierung medizinischer Handlungen am Lebensende hat eine intensive Debatte ausgelöst. Das Urteil und die akademisch vorgetragene Kritik werden einer grundlegenden medizinethischen Analyse unterworfen. Sie betrifft die objektive Eingrenzung der Zulässigkeit einer Behandlungsbegrenzung und die Subsumtion des Wachkomas als irreversibel tödliches Grundleiden, das ärztliche Ermessen bei der Indikationsstellung, die normative Einordnung einer Ernährungstherapie am Lebensende und die Verbindlichkeit von Patientenverfügungen. Die medizinethische Kritik offenbart eine unzureichende Wahrnehmung medizinischer und medizinethischer professioneller Dokumente (...) und den Rückgriff auf medizinethisch veraltete Konzeptionen der Sterbehilfe durch das Gericht. Die Folge ist eine fehlerhafte Subsumtion der Wachkomapatienten in die Kategorie irreversibel tödlicher Erkrankungen und eine inhaltliche Schwächung der Verbindlichkeit von Patientenverfügungen. Ein Leitmotiv der medizinethischen Auseinandersetzung mit der tiefen Hirnstimulation (THS) ist die Beschäftigung mit Fragen personaler Identität. Da es sich bei personaler Identität auch um ein Problem der theoretischen Philosophie handelt, wird in diesem Aufsatz nicht nur die praktische Frage nach der ethischen Legitimation der THS durch informierte Einwilligung gestellt und ein modifiziertes Legitimationskriterium für wesensändernde THS erarbeitet. Vielmehr wird zunächst versucht, das Problem, um das es in der Debatte um THS und personaler Identität geht, besser zu verstehen.

Klinische Ethikberatungen sollten dokumentiert werden, wenn dies mit den Klienten entsprechend vereinbart worden ist. Der Beitrag plädiert für eine stetige Dokumentation von Ethikberatungen (interne Dokumentation). Auf diesen Grundlagen können unterschiedliche Berichte über Ethikberatungen mit unterschiedlichen Inhalten und unterschiedlichen Adressaten entstehen. Es wird zwischen einem Ergebnis- und einem Verlaufsbericht unterschieden. Diese werden von summarischen Zeitraumberichten oder einem Berichtssystem Ethikberatung abgegrenzt. Ergebnisberichte mit einer Darlegung des Beratungsergebnisses und den wichtigsten ethischen Argumenten werden häufig in Krankenunterlagen eingeordnet. Verlaufsberichte dienen in der Regel eher (...) Ausbildungs- und Qualitätssicherungszwecken.Dokumentationen in diesem weiten Sinn können zu einer Professionalisierung der Ethikberatung beitragen. Dabei ist es aber von zentraler Bedeutung, sich die Zielsetzung der jeweiligen Form von Dokumentation zu vergegenwärtigen und ehrlich und aufrichtig nach Schwächen und Entwicklungspotenzialen der Beratung zu ethischen Fragen im klinischen Alltag zu suchen. Non-indoctrinational moral education involves teaching children to engage in ethical inquiry. This means that, since ethical inquiry has the status of a craft, the students will be apprentices in that craft. The classroom becomes, for this purpose, a community of ethical inquiry ? an ethical atelier where students learn the tools, methods, practices and procedures which craftsmen associated with that tradition customarily utilize. It is only when one is adept at the generic procedures of reasoning that one can be adept (...) at specifically moral reasoning, but to make the transition possible, the generic procedures should be taught within the humanistic and critical context of philosophy, and within the setting of a community of ethical inquiry. The work of Lawrence Kohlberg has become the central focus in both the research and applied dimensions of moral education. While teachers and academics are generally familiar with Kohlberg's account of his six stages of moral development, his hints about a highest and culminating seventh stage have had no sustained critique. This essay attempts to provide a detailed account and critique of all of Kohlberg's writings dealing with stage seven, from a philosophical standpoint. This essay critiques Kohlberg's analysis of Moore's (...) naturalistic fallacy, and rejects his attempt to disarm the fallacy by adopting a strategy of ?parallelism?, or ?complementarity?. I argue that it might be better to accept the fact that one cannot derive an ought from an is, and then to view ought-claims as selected or preferred is-claims. This allows morality to remain sui generis, and the support for a moral choice must arise from the complete ?story? or world-view in which it is embedded. Stage seven is not just any ?whole story?, however, but the best or ideal whole story. As well, it serves as the answer to the fundamental ethical question, ?but why should I be moral in the first place?? Stage seven gains its justificatory power from its stance of empathetic identification of the moral agent with others, and with the cosmos as a whole, as thinkers as varied as Marcus Aurelius and Teilhard de Chardin have suggested. If stage seven is, as Kohlberg argues, an ethics of love, and if the first six stages are to be thought of as comprising an ethics of justice, then what is to be done if they conflict? Kohlberg deals with this question, and eventually decides in favour of justice, even given the seventh stage as somehow the ground of all normativity in his system. I argue that he cannot consistently adopt a parallelist thesis here, but needs to recognize the normatively fundamental character of his own seventh stage. It serves as his ?whole story?, on which the previous six stages all rest. Kohlberg's own thesis forces him to retain an ethics of justice only until one reaches the level of agape. Then, as with all higher stages, the lower stages are not abandoned, but are taken up and enriched by the thinking and acting which emerge from the higher stage perspective. Neither justice nor agape can stand alone as sufficient basis for an adequate ethics. But it is agape that is the more fundamental, and which enriches justice without rejecting its generally overwhelming claims. Stage seven consciousness simply reminds one that justice is not enough, even though it does constitute the largest part of ethics. (shrink)

Gedächtnis-Enhancement oder Memory-Enhancement ist ein Teilbereich der verschiedenen Ansätze zur pharmakologischen und technischen Verbesserung menschlicher Leistungsfähigkeit. Wie Erfahrungsberichte von Menschen mit von Natur aus gesteigertem Erinnerungsvermögen zeigen, ist eine Steigerung der Gedächtnisfähigkeit prinzipiell möglich. Allerdings verweisen diese Erfahrungen auch auf einige Komplikationen und Beschwernisse infolge dieser gesteigerten Leistungsfähigkeit. Es wird argumentiert, dass erstens diejenigen philosophischen Theorien, die die Funktion des Gedächtnisses v. a. in der Speicherung von Informationen lokalisieren, einige dieser Probleme nicht antizipieren und nur unzulänglich erklären können. Zweitens wird (...) argumentiert, dass philosophische Konzepte zur Funktion von Erinnern und Vergessen, die deren Bedeutung bei der Bildung eines normativ geleiteten Selbstverständnisses in den Vordergrund stellen, diese und weitere mögliche Komplikationen deutlicher in den Blick bekommen können. In der Medizinethik sind der Respekt vor der Patientenselbstbestimmung, das Nichtschadensgebot, das Handeln zum Wohl des Kranken und das Gerechtigkeitsgebot praxisrelevante Prinzipien. Anhand des Beispiels der Frühintervention und Akutbehandlung schizophrener Störungen wird aufgezeigt, dass es in der psychiatrischen Praxis zu einer Kollision dieser Prinzipien kommen kann. Der frühe Krankheitsbeginn und der häufig chronische Verlauf schizophrener Störungen führen zu großem Leid der Betroffenen und ihrer Angehörigen sowie zur ökonomischen Belastung der Solidargemeinschaft. Die negativen Folgen einer verzögerten Intervention stehen den Risiken der (...) Stigmatisierung sowie den möglichen Nebenwirkungen durch die psychotherapeutische oder psychopharmakologische Behandlung gegenüber. Es wird für eine an der konkreten Situation orientierte, lebensnahe und dynamische Ethik plädiert, die vom konkreten Fall aus diskutiert und verschiedene Perspektiven berücksichtigt – mit dem Ziel von einer Arztethik und Patientenethik zu einer Verantwortungspartnerschaft zu gelangen. This paper examines some of the possible legal implications of the production, marketing and use of expert systems. The relevance of a legally useful definition of expert systems, comprising systems designed for use both by laymen and professionals, is related to the distinctions inherent in the legal doctrine underlying provision of goods and provision of services. The liability of the sellers and users of, and contributors to, expert systems are examined in terms of professional malpractice as well as product liability. (...) Befürworter des Verfahrens weisen die Kritik daher als dunkel zurück oder deuten sie so, dass sie das Verfahren zulässt. Dieser Artikel erläutert den Kern (...) der Zweckformel (im Zusammenhang mit anderen Formulierungen des kategorischen Imperativs). Dieser Deutung zufolge ist die Zeugung von Retterkindern in der Tat eine Form der Instrumentalisierung, die ich präemptive Instrumentalisierung nenne. This book covers a crucial period for the development of state education in Britain; the advent of the comprehensive debate before and during the Second World War; the War years themselves and the 1944 Education Act; the post-War Labour Government; and Churchill's last government in a time of education expansion. From the 1960s, the focus shifted to questions of social deprivation and educational opportunities, secondary school selection, the debate on standards, Robbins and higher education, and the continuing theme of the (...) dominance of public schools. The book is divided into four sections, which are then divided into chapters. Each chapter takes as its main reference point a key issue within the chronological framework of the book, e.g. resistance to secondary education for all, politics and textbooks, multilateral and technical schools, pressure groups and the 1944 Education Act, Churchill and the Conservatives. The present article discusses the two stages that, according to the vinaya texts, precede a full ordination of a woman candidate within the samgha: the stages of novice and of probationer. In the context of the present-day discussions on the position of nuns within the samgha, and on the introduction of a nuns' ordination in lineages where today this is not fully accepted, the article focuses on the formal issues that in the Dharmaguptaka vinaya tradition precede the nuns' ordination and (...) thus prepare the basis on which the full ordination was traditionally built. A relatively high incidence of unsatisfactory review decisions is widely recognised and acknowledged as ‘the peer review problem’. Factors contributing to this problem are identified and examined. Specific examples of unreasonable rejection are considered. It is concluded that weaknesses of the ‘peer review’ system are significant and that they are well known or readily recognisable but that necessary counter-measures are not always enforced. This study examined scientific tolerance as a human way to life in the context of Sunnah, a much debatable topic among critics and scholars. The study also highlighted prophetic visions in the application of scientific tolerance. Using a normative descriptive approach in this qualitative research, the data was collected from library archives and Islamic data sources. This approach enabled to raise questions about the nature of scientific tolerance in the light of Sunnah, prophetic mechanisms used to establish the scientific tolerance, (...) and its advantages. The findings revealed that scientific tolerance was integrated to the prophetic visions and the Sunnah, aiming at peace, tranquility, and stability for the entire mankind. The study found out how the Sunnah of the Prophet laid the foundation of scientific tolerance, and how it was carried forward by the Companions and mujtahids through their discussions, dialogues, and debates. It was also observed that the scientific tolerance reached its peak in the era of Arab and Islamic civilization, through the translation movement that began in the Umayyad era and reached its culmination, and gained heights through scientific discoveries, innovations, and civilizational achievements. In the Abbasid era, the subsequent transfer and translation of these languages into Latin and other European languages, further enhanced the depth of scientific tolerance in the contemporary renaissance and modern civilization. abstract: In Kephalaia Gnostika, the third part of his great trilogy on the ascetic and contemplative life, the early Christian desert monk Evagrios of Pontus made a statement that resonates with the story told by the Buddha in the Aggañña Sutta. Evagrios declared that there had been a time when evil did not exist, and from this premise, he extrapolated that there will come a time when evil will not exist anymore. Both Evagrios and the Buddha, it seems, were essentially (...) optimistic in their teaching, convinced that despite being subject to a "fall," human beings have agency and can work toward establishing virtue in their lives and experiencing the fruits of this labor. In order to do this, a sophisticated understanding of how the mind works is key, and the two teachers, within the lineaments of the thought worlds of their respective backgrounds, explore what contemplation and meditation offer to this end. They also discuss other qualities that contribute to the development of a "gentle warrior," a character recognizable in both traditions and notable for the level to which they have erased subjectivity and their dedication to the achievement of good outcomes. Evidence can be found in both Buddhist and Christian writings of the recognition of correlations between the structure of the cosmos and spiritual or religious experience. (shrink)

Zur patientenorientierten Behandlung bei nichteinwilligungsfähigen Patienten werden aktuell der Einbezug oder auch die Entscheidung durch ein Ethikkonsil oder klinisches Ethikkomitee (KEK) gefordert. Damit die Entscheidung des Entscheidungsträgers durch das KEK unterstützt werden kann, müssen Zuständigkeiten, Besetzung und Arbeitsweise des Gremiums klar umschrieben sein.

ZusammenfassungDie von einem multiprofessionellen Behandlungsteam durchgeführte Symptombehandlung bei inkurablen Patienten am Lebensende erweist sich als hoch effektiv und verschafft den meisten Patienten eine ausreichende Linderung. Dennoch verbleibt ein Patientenanteil, bei dem auch unter Berücksichtigung physischer, psychischer, sozialer und spiritueller Bedürfnisse kein erträglicher Zustand erreicht werden kann. In diesen Extremfällen können Sedierungsmaßnahmen zur Linderung eingesetzt werden. Der Begriff und das Angebot der terminalen Sedierung sind in vielerlei Hinsicht umstritten. Eine Kasuistik soll die Problemstellung veranschaulichen und zeigen, wie die terminale Sedierung von (...) erfahrenen Behandlern als ergänzendes Instrument der Symptombehandlung eingesetzt werden kann, auch wenn sie keine perfekte Antwort auf unerträgliches Leiden in der Sterbesituation darstellt. Im Literaturvergleich werden aktuelle medizinische, rechtliche und psychosoziale Fragen diskutiert. (shrink)

Der Beitrag diskutiert Möglichkeiten emotionalen Lernens in einzelfallbezogenen Lernarrangements wie etwa klinische Ethikberatungen und Workshops, die mit Einzelfällen arbeiten. Es wird ein didaktisches Rahmenkonzept entwickelt, das vor allem auf die Ermöglichung emotionalen Lernens abzielt. Dabei werden entsprechende Lernziele formuliert, emotionale Themen in diesen Lernarrangements benannt und Methoden dargestellt, wie Erwachsenenbildner diese emotionalen Themen so bearbeiten können, dass ein emotionales Lernen ermöglicht wird. Dabei wird auch ein konzeptueller Rahmen für diese Lernarrangements benannt, der von einem deliberativen Ethikverständnis ausgeht. Emotionales Lernen als (...) Förderung der Sozial- und Selbstkompetenz wird dabei als eine Schlüsselqualifikation verstanden, die gegen die Fach- und Methodenkompetenz abgegrenzt wird. (shrink)

Through Fichtes “Wissenschaftslehre” knowledge has been accepted as the basic element of all scholarship, whereas faith belongs to religion.

In den westlichen Industrienationen gilt das Prinzip der informierten Einwilligung als das Zentralelement medizinischer Forschungsethik. In anderen, stärker die Relationalität als die Individualität von Personen betonenden Kulturen hingegen werden medizinische Entscheidungen traditionell eher durch die Gemeinschaft bzw. ihr Oberhaupt getroffen. Um verschiedenen kulturellen Normen gerecht zu werden, wird international tätigen Forschungsteams häufig empfohlen, den Community Consent und den Informed Consent einzuholen. Ausschlaggebend soll dabei letztlich der Informed Consent des Individuums sein. Es soll die Teilnahme auch dann verweigern können, wenn die (...) Gemeinschaft bzw. ihr Repräsentant dem Vorhaben zugestimmt hat. Der Beitrag diskutiert, ob eine solche Kopplung von Community Consent und Informed Consent tatsächlich geeignet ist, den Ansprüchen beider Prinzipien gerecht zu werden. Es wird argumentiert, dass die Kopplung von Community Consent und Informed Consent ethisch problematisch ist, wenn der Gemeinschaft hierbei ein Vetorecht eingeräumt wird, das geeignet ist, die Realisation konträrer individueller Interessen und damit das Selbstbestimmungsrecht der Betroffenen zu unterlaufen. Um zu gewährleisten, dass in interkulturellen Forschungszusammenhängen sowohl der individuellen als auch der relationalen Autonomie von Personen angemessener Raum gewährt wird, wäre es empfehlenswert, den Informed Consent ausdrücklich mit einer Community Consultation zu koppeln. Hier käme die Entscheidung gegen, aber auch für eine Studienteilnahme in letzter Instanz klar dem Individuum zu, während die Vorzüge einer Einbeziehung der Gemeinschaft in den Entscheidungsfindungsprozess anerkannt und genutzt werden könnten.
